Does anyone know anything about child support cases?

What will happen if my soon to be ex wife refuses to show up to her court date over childsupport/custody/divorce. She is on a trip and sent me a text and said ecpect a continuance...she said you dont know what you're talking about there is no court date and i wont be there.Does anyone know anything about child support cases?

It is possible that her lawyer could ask for a continuance and be granted, but judges REALLY don't like that, especially in family court. It is also entirely possible that her lawyer will show up, request a continuance and the judge will say NO, if she doesn't care about her kids futures then I will just decide for her.





If you show up and she doesn't, man that is like the jackpot! If you present anything close to reasonable the judge will sign off on it. For example you could say you want joint custody of the kids with you being the primary custodial parent, and her having every 1st, 3rd, and 5th weekend, and 2 weeks int he summer, and alternating holidays. You want her to have to provide medical insurance for the kids. And you want XXX amount in child support per month.





Take a look at your states on line child support calculator and see what would be reasonable with what you make and what she makes.





I have seen this happen twice. One time the ex wife wouldn't show up to determine child support, and wouldn't provide her financials. So the judge told the guy to get a written statements of salary from someone in his ex wifes field and he would gladly base child support off of that amount. Well the guys ex was a nurse, and he went and got a salary deposition of a premie-neuro surgeon nurse, and the judge accepted it!!! She had to pay about 3.5 times more than she would have if she had cooperated.





The other instance was a mother not showing up for charges of contempt that she wasn't paying her child support. Since she was a no show the court issued a warrant for her arrest and the only way she could get out of jail is by forking over over $2000 in back child support.

Anyone who is not sure if their case is on the docket can call the court clerk and ask.
It depends. She could have a lawyer and if she does they will likely show up for her and ask for a continuance and it'll get postponed.


If she doesn't have a lawyer and doesn't show the judge will usually grant you want you want by default as long as the judge doesn't have questions that your ex needs to be there to answer.





When I got divorced I knew about the court date and all but I didn't want to take off work since we weren't fighting over anything. We were told as long as one of us showed up to get the papers they would still grant the divorce so my ex went.





With my son (not by my ex husband) his father didn't show up to court for the child support and I won by default. What I put down as what I wanted for the custody i got and the state set the child support.
