ASFA can be used only in situations where there has been termination of parental rights before. It is up to the Child protection agency and the judge to determine if it applies to a specific case. There are times where they decide it is not best to apply ASFA to a case. So yes it is determined on a case by case basis based on what is truly best for the child(ren) involved.Is the Adoption %26amp; Safe Families Act strictly followed in all child abuse/neglect cases?
The act was only created as a way for social services to get their cut in the adoption industry.
